Provided that it concerns the sale of used original software that was first placed on the market in the European Economic Area (EEA) or the EU with the consent of the rights holder, the entire transaction is legally compliant. This was confirmed by the European Court of Justice in its ruling of July 3, 2012. In July 2013, the Federal Court of Justice of Germany also confirmed the legality of trading in used software licenses.
