Legal Framework
The resale of used software is permitted in the EU under the principle of exhaustion in European copyright law, subject to the applicable conditions. In particular, the software must first have been lawfully placed on the EU market, and the seller must permanently transfer the relevant rights and cease using its copy. The Court of Justice of the European Union and Germany’s Federal Court of Justice have addressed these conditions in their case law.
